These Terms of Service (“Terms”) govern your access to and use of sclandscapingcos.com (the “Site”), operated by S&C Landscaping LLC (“S&C Landscaping,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful, personal, non-commercial purposes to learn about and request our services. You agree not to misuse the Site, attempt to gain unauthorized access to it or its systems, interfere with its normal operation, use automated tools to scrape or harvest its content, or use it in any way that violates applicable law or these Terms.

2. No Offer; Estimates and Informational Content

Content on the Site — including service descriptions, project photographs, pricing indications, and blog articles — is provided for general informational purposes only. It does not constitute a binding offer, contract, professional advice, or a guarantee of any particular result. Photographs and project examples are illustrative and may depict past work, design concepts, or representative examples; actual results vary with site conditions, climate, materials, plant availability, and other factors. Any quote or estimate is non-binding and subject to an on-site assessment and a separate written agreement. We strive for accuracy but do not warrant that Site content is complete, current, or error-free, and we may change it at any time without notice.

3. Intellectual Property

All content on the Site — including text, graphics, logos, the S&C Landscaping name and marks, photographs, designs, and the selection and arrangement of that content — is owned by or licensed to S&C Landscaping LLC and is protected by United States and international intellectual property laws. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our prior written permission, except that you may view and print pages for your own personal, non-commercial reference.

4. Third-Party Links and Services

The Site may link to or reference third-party websites and services that we do not control. We are not responsible for their content, policies, or practices, and a link does not imply our endorsement. Accessing third-party sites is at your own risk and subject to their terms.

5. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT IT WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. This section applies to the Site only and does not affect any warranty we may separately provide in a signed services contract.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, S&C LANDSCAPING LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

7. Indemnification

You agree to indemnify and hold harmless S&C Landscaping LLC and its owners, members, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms or applicable law.

8. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in El Paso County, Colorado, and you consent to the personal jurisdiction of those courts.

9. Changes to These Terms

We may modify these Terms at any time. Updated Terms become effective when posted with a new “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

10. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms are the entire agreement between you and us regarding your use of the Site and supersede any prior understandings on that subject. They do not supersede a separate signed services contract between you and S&C Landscaping.
